CONDITION OF ENTRY

 

1. Promotional Period: The promotional period during which Entrants may enter the Promotion online commences 25.12.20 and ends on 05.01.21 (the Promotional Period). 
2. How to Enter: To enter the competition, entrants must comply with the following rules set out by ROBERTSONKUR. Entrants must follow (robertson.kur the Promoter), share (the Promoter), like and comment on promotional content from (the Promoter). All entries must complete all four requirements or the entry will be invalid. If an Entrant uses fraudulent methods or otherwise attempt to circumvent the rules, the entry may be removed from eligibility at the sole discretion of the Promoter. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
3. Eligibility and Participation: This Promotion is only open to individuals who are 18 years and above as of the date of entry, who enter during the Promotional Period. The Promotion is open to internationally and can be void where prohibited by law. By entering this Promotion, each Entrant represents and warrants that s/he meets the eligibility requirements of these Terms.  
4. Prizes: There are 12 prizes to be won. All prizes are at the sole discretion of the Promoter and may be subject to change. In the event of the Prizes being unavailable and the Promoter has used all reasonable efforts to arrange the Prizes it reserves the right to substitute Prizes. Any and all expenses incurred by Entrants, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the Winners. No substitution of Prize or transfer/assignment of Prize to others or request for the cash equivalent by the winner is permitted.
5. Judging: The winners of the Prizes will be the 12 best valid entries submitted as judged by the judging panel, having regard to amount of likes, creativity, engagement with ROBERTSONKUR, shares, comments and originality. The Promoter’s decision is final.
6. Notification: The Winner will be notified via instagram by the Promoter each day of the 12days of giveaways, commencing the 25th of December 2020. Instagram contact will contain instructions on how to contact the Promoter and redeem the Prize. The Promoter shall have no liability for the Winners who failure to receive notices due to Winners security settings or for the Winners non-functioning Facebook account or profile, or account settings.
7. Redemption Period: The Redemption Period, during which the Winner may claim the Prize, commences on the day of contact via instagram and ends 14days after. (Redemption Period).
8. Unclaimed Prize and Second Notification Date: If the Prize remains unclaimed by the end of the Redemption Period, an alternative Winner may be selected. Non the less the prize to the original winner will be invalid.
9. Delivery: The Prize will be delivered to the address supplied by the Winner (Delivery Date). To the extent permitted by law, the Promoter will not be responsible for a delay in delivering the Prize by the Delivery Date where such delay has been caused by a third party.
10. Rights Granted: By entering this Promotion Entrants understand that the Promoter, anyone acting on behalf of the Promoter, or its respective licensees, successors and assigns will have the right, where permitted by law without any further notice, review or consent to: print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, the Entrant’s entry, including, without limitation, the entry and Winner's name, portrait, picture, voice, likeness, image or statements about the Promotion, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
11. Rights of the Promoter: The Promoter reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Promotion should (in its sole discretion) a virus, bugs, non-authorised human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Promotion. In such case, the Promoter may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by the Promoter. The Promoter reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Promotion or website or violates these Terms.The Promoter has the right, in its sole discretion, to maintain the integrity of the Promotion, to void entries for breaching the Terms, including multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Promotion rules; or the use of bots, macros or scripts or other technical means for entering.
12. Legal Warning: Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promoter’s website, or the information on the website, instagram or any social media platform linked with ROBERTSONKUR or to otherwise undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.
13. Liability: Nothing in these Terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Consumer Act 2010 (Cth) or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter and the Entrant exclude all liability for indirect, special or consequential, loss or damages (including loss of opportunity), arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; and (d) any tax liability incurred by an Entrant.To the extent permitted by law, the Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or online form to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to an Entrant’s or any other person's computer related to or resulting from participation or downloading any materials in connection with this Promotion.Any costs incurred by an Entrant associated with participating in the Promotion, including accessing the Promoter’s website or telephone enquiries in relation to the Promotion, are the sole responsibility of the Entrant.
14. Force Majeure: If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and prevents the Promoter from complying with these Terms, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Promotion.
15. Privacy: The Promoter’s collection, use and disclosure of personal information (“PI”) is subject to ROBERTSONKUR Privacy Policy (available at www.houseofkur.com) and is incorporated into this agreement. The Promoter collects PI in order to conduct the Promotion and may, for this purpose, disclose PI to third parties, including but not limited to agents, contractors, service providers and refund suppliers. An Entrant’s entry into this Promotion is conditional on providing this PI. If Entrants opt-in by ticking the opt-in box at the time of entering the Promotion, Entrants consent to the information they submit online being entered into a database, this information may be used in any media, for future promotional, marketing, publicity, research and profiling purposes including sending electronic messages or telephoning the Entrant, without any further reference or payment or other compensation to the Entrant. All claims to access, update or correct any PI becomes the property of the Promoter. The Promoter may disclose PI overseas at its sole discretion.
16. Severance: If a provision of these Terms is held to be void, invalid, illegal or unenforceable, that provision must be read down as narrowly as necessary to allow it to be valid or enforceable. If it is not possible to read down a provision (in whole or in part), that provision (or that part of that provision) is severed from these Terms without affecting the validity or enforceability of the remainder of that provision or the other provisions in these Terms.
17. Social Media: Social media membership pages, applications and use of social media generally is subject to the prevailing terms and conditions of use of the social media platform. Unless otherwise indicated in these Terms, the Promotion is in no way sponsored, endorsed or administered by, or associated with, any social media platform including, but not limited to, Instagram, Facebook, Twitter and Pinterest. If an Entrant uses social media to participate in the Promotion, the Entrant understands that they are providing their information to the Promoter and not to any social media platform. Entrants are solely responsible and liable for the content of their entries and any other information they transmit to other Internet users. By participating in this Promotion, the Entrant releases Instagram, Facebook, Twitter, Pinterest or applicable social media site from all claims, liabilities, suits, actions and expenses, including costs of litigation and reasonable legal costs associated with this Promotion.
18. Amendments: If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its sole discretion to modify the terms of the Promotion, including the Prizes and these Terms, subject to approval of the gaming authorities in each State and Territory, where such approval is required. These Terms may be amended or replaced from time to time if required by any regulatory authority.
19. Jurisdiction: These Terms are governed by the laws of New South Wales and the Commonwealth of Australia. Entrants submit to the jurisdiction of the courts of New South Wales.
20. Promoter: The Promoter is Robertson Kur (ABN 82 792 426 072) of 55 Gibson Street, Silverdale, NSW 2752 (“Promoter”). Claims will be processed by the Promoter.
