ORIGINAL & PRIVATE COMMISSION POLICY
ORIGINAL WORKS AND PRIVATE COMMISSIONS
Original paintings, sculptural works, and private commissions are unique objects created under ROBERTSONKUR and placed into a collector's environment as permanent acquisitions. Each original work is accompanied by a Certificate of Authenticity and recorded in the ROBERTSONKUR Studio Archive upon placement.
All acquisitions of original works are final. ROBERTSONKUR does not offer returns, exchanges, or refunds on original works or private commissions under any circumstances.
HIGH VALUE ACQUISITIONS
For any original work with an acquisition price exceeding $10,000 AUD, the following additional terms apply.
Reservation Deposit
To secure the work, the collector must complete a non-refundable reservation deposit specific to the individual work. This deposit serves as a formal commitment to acquire the work and removes it from availability to other collectors.
Balance of Payment
The remaining balance must be paid via bank wire transfer within 48 hours of deposit confirmation. If payment is not received within this window, ROBERTSONKUR reserves the right to cancel the transaction. The reservation deposit will be retained to cover the loss of opportunity and any administrative costs incurred, and the work will be offered to the next collector in the studio's priority register.
Identity Verification
For acquisitions exceeding $10,000 AUD, the collector may be required to provide government issued identification prior to finalisation of the acquisition agreement, in accordance with international art market standards.
Formal Agreement
All acquisitions of original works are subject to a formal written acquisition agreement between ROBERTSONKUR and the collector. This agreement governs all terms of ownership, intellectual property, delivery, and resale conditions.
OWNERSHIP AND INTELLECTUAL PROPERTY
Legal title of the physical work transfers to the collector only upon receipt of full payment. ROBERTSONKUR and Kurt Robertson retain all intellectual property, copyright, and licensing rights in perpetuity.
The collector may not reproduce, photograph for commercial purposes, or create derivative works from any ROBERTSONKUR original without prior written consent from the studio.
The Certificate of Authenticity issued with each work must remain permanently with the work, including in the event of any future permitted resale or transfer.
SHIPPING, INSURANCE AND CARE
All freight, packaging, shipping, and insurance costs associated with the delivery of original works and private commissions are the sole responsibility of the collector. These costs will be communicated at the time of acquisition and are non-refundable.
The collector assumes sole responsibility for insuring the work against loss, theft, or damage from the moment it leaves the studio's possession. The work must be maintained, stored, and displayed in a manner consistent with professional conservation standards appropriate to its medium and materials.
RESALE AND TRANSFER
To protect the integrity of the studio's market and the collector's investment, the following resale conditions apply to all original works and private commissions.
The collector may not sell, auction, lend, or transfer the work within 24 months of the acquisition date without prior written consent from ROBERTSONKUR.
Following the 24 month period, should the collector wish to sell the work, ROBERTSONKUR holds the right of first refusal. The collector must submit a written offer to the studio at the intended sale price. ROBERTSONKUR will have 30 days to accept. If the studio declines, the collector has a 3 month window in which to offer the work to a third party. Any third party sale must not be made at a price lower than that offered to the studio, and the incoming collector must agree in writing to abide by these same terms.
ROBERTSONKUR offers a studio facilitated resale service for collectors who wish to place a work through the studio rather than independently. Enquiries regarding facilitated resale should be directed to support@robertsonkur.com.
Breach of these resale and transfer terms will void the transfer and may result in legal action under the laws of New South Wales, Australia.
EXHIBITION AND LOAN
Should the collector wish to lend the work for a public or institutional exhibition, written permission from ROBERTSONKUR must be obtained in advance.
ROBERTSONKUR reserves the right to request a temporary loan of any placed work for significant museum or institutional exhibition purposes. All freight and insurance costs associated with such a loan will be covered by the studio or the organising institution.
GOVERNING LAW
All original work acquisitions and private commission agreements are governed by the laws of New South Wales, Australia.
