TERMS OF SERVICE

This website is operated by ROBERTSONKUR, a studio founded by Kurt Robertson and based in Sydney, Australia. Throughout this document, the terms "we", "us" and "our" refer to ROBERTSONKUR. By visiting this site and engaging with the studio, whether browsing, enquiring, acquiring a work, or entering the Collector Register, you agree to be bound by the terms set out here. Please read them carefully. Our site is hosted by Shopify Inc., which provides the infrastructure through which works and products may be acquired.
THE STUDIO AND ITS WORKS
ROBERTSONKUR operates as an artistic studio and collector house. Works offered through this site, including paintings, sculptures, private commissions, and room fragrances, are presented as artistic editions, not commercial commodities. All works are created in Sydney, Australia, under the direction of Kurt Robertson. Every work carries an acquisition code that forms part of the permanent studio record. This code identifies the work within the ROBERTSONKUR archive and may be used to enter the Studio Collector Register.
ACQUIRING WORKS
Works are offered for acquisition through this site, through private commission, or through direct studio dialogue. All acquisitions are final. ROBERTSONKUR does not offer returns, exchanges, or refunds on any artwork, sculpture, or private commission. The terms governing each acquisition, including commission scope, materials, dimensions, and delivery, are outlined in the relevant acquisition agreement issued by the studio at the time of purchase. For room fragrances and lifestyle products, all sales are also final. Please refer to our Acquisition Policy for full details. Prices are listed in Australian Dollars and are subject to change at the studio's discretion. Historical pricing is not binding.
PRIVATE COMMISSIONS
Private commissions are collaborative works undertaken between ROBERTSONKUR and the collector. All terms, scope, timeline, materials, and ownership rights are governed by a formal commission agreement issued prior to commencement of work. Enquiries may be directed to support@robertsonkur.com.
COLLECTOR REGISTER
The Collector Register is a studio record, not a commercial subscription. By entering the register, you provide your details to ROBERTSONKUR for the purpose of studio correspondence. Your information will not be sold, shared with third parties, or used for any purpose beyond direct communication from the studio. Please refer to our Privacy Policy for full details.
INTELLECTUAL PROPERTY
All works, images, text, codes, concepts, exhibition materials, and brand identity displayed on this site are the intellectual property of ROBERTSONKUR and Kurt Robertson. No content may be reproduced, distributed, resold, or used without express written permission from the studio. The ROBERTSONKUR acquisition code system, series nomenclature, and archival record structure are proprietary to the studio.
PROHIBITED USES
You may not use this site or its content for any unlawful purpose, to infringe upon the intellectual property rights of ROBERTSONKUR or any third party, to transmit malicious code or harmful material, to collect or misuse the personal information of others, or to misrepresent your identity or affiliation with the studio. ROBERTSONKUR reserves the right to terminate access to this site for any violation of these terms.
USER SUBMISSIONS
Any correspondence, enquiries, proposals, or creative submissions directed to the studio may be used by ROBERTSONKUR at its discretion for the purposes of responding to and developing the studio's work. ROBERTSONKUR is under no obligation to maintain submissions in confidence beyond what is outlined in our Privacy Policy, to compensate for any submission, or to respond to unsolicited proposals.
ACCURACY OF INFORMATION
We endeavour to ensure all information on this site is accurate and current. Colours and finishes of works as displayed on screen may vary from the physical work due to differences in monitor calibration and reproduction. ROBERTSONKUR accepts no liability for colour discrepancies between digital representation and the acquired work.
THIRD-PARTY LINKS
This site may contain links to third-party websites. ROBERTSONKUR is not responsible for the content, accuracy, or practices of any third-party site. Any engagement with third parties is at your own discretion.
LIMITATION OF LIABILITY
To the fullest extent permitted by Australian law, ROBERTSONKUR shall not be liable for any indirect, incidental, or consequential damages arising from your use of this site or any works acquired through it.
INDEMNIFICATION
You agree to indemnify and hold harmless ROBERTSONKUR, Kurt Robertson, and any associated parties from any claim, demand, or damages, including reasonable legal fees, arising from your breach of these terms or your violation of any law or third-party right.
SEVERABILITY
If any provision of these terms is found to be unlawful or unenforceable, that provision shall be applied to the fullest extent permitted by law and the remainder of these terms shall continue in full force and effect.
GOVERNING LAW
These Terms of Service are governed by the laws of New South Wales, Australia. Any disputes arising from these terms shall be subject to the jurisdiction of the courts of New South Wales.
CHANGES TO THESE TERMS
ROBERTSONKUR reserves the right to update these terms at any time. Changes will be posted to this page with a revised date. Continued use of the site following any update constitutes acceptance of the revised terms.
